Terms & Conditions

1. Licensed Contractor
All work is performed by a contractor licensed in the State of California in accordance with regulations set by the California Contractors State License Board. License number will be provided on all contracts and invoices.

2. Scope of Work
Work will be completed as described in the written estimate/contract. Any additional work or deviations must be approved via written change order and may result in additional charges.

3. Three-Day Right to Cancel (Residential Work)
For residential projects, the client has the right to cancel this contract within three (3) business days of signing, as required under California Home Solicitation Sales Act.

​

4. Payment Terms (CA Compliance)

• Down payment will not exceed $1,000 or 10% of the contract price (whichever is less) per California law

• Progress payments may be required based on work completed

• Final payment is due upon completion

• Late payments may incur reasonable fees as permitted by law

5. Permits & Regulations
Client is responsible for obtaining all necessary permits unless otherwise stated. All work will comply with applicable state and local regulations, including relevant portions of the California Building Code.

6. Underground Utilities (USA Dig Requirement)
Client must ensure all underground utilities are properly marked prior to work. Notification to Underground Service Alert of Southern California (dial 811) is required before excavation. Contractor is not liable for damage to unmarked or incorrectly marked utilities.

7. Site Conditions & Unknowns
Unforeseen conditions (rock, groundwater, buried debris, unstable soil, etc.) may require additional work and cost. Client agrees to pay for such necessary adjustments.

8. Access & Property Conditions
Client must provide safe and clear access to the jobsite. Contractor is not responsible for damage to driveways, landscaping, or structures that are necessary to access the work area unless otherwise agreed.

9. Insurance & Liability
Contractor carries general liability insurance and, if applicable, workers’ compensation insurance in accordance with California requirements.
Contractor is not responsible for:

• Pre-existing conditions

• Soil movement, erosion, or settling after completion

• Damage due to improper drainage design not included in scope

10. Delays
Contractor is not liable for delays caused by weather, permitting issues, material shortages, or other factors beyond control.

11. Cleanup & Hauling
Standard cleanup is included. Export of soil, debris hauling, or additional grading not specified in the contract will be billed separately.

12. Mechanics Lien Notice (Required in CA)
Client is hereby notified that anyone who helps improve the property but is not paid may record a mechanics lien. Contractor reserves the right to file a lien for non-payment in accordance with California law.

13. Warranty Disclaimer
Due to the nature of excavation and grading, no warranty is provided for:

• Soil settling

• Drainage performance unless explicitly stated

• Natural ground movement

• ​

14. Dispute Resolution
Disputes shall first be attempted to be resolved informally. If unresolved, disputes may be handled through mediation, arbitration, or legal action in the State of California.

15. Entire Agreement
This document, along with the estimate/contract, represents the full agreement between both parties.
